Partner spot terms

These terms govern the sale of advertising spots on bestin-richmond.com. They are addressed to
businesses acting in the course of their trade. Booking a spot means accepting these terms.

1. Purpose

The publisher makes advertising spots available on the ranking pages of the site. These spots
are identified as advertising and kept separate from editorial content.

2. How spots are awarded, the auction, and duration

Each ranking page carries at most 10 spots. The advertiser freely chooses
the amount of its bid, above a minimum entry amount shown at the time of booking, stated before
tax. Bids go up in steps of five dollars. The display order follows the amounts,
from highest to lowest; equal amounts are separated by the booking date.

A spot is bought in a single payment. It is displayed as long as the
site remains online
and as long as the advertiser’s bid is among the 10 highest on
the page. No duration is guaranteed beyond that: when a new advertiser bids more, the advertisers
bidding less move down one spot and, if they drop out of the top 10, their spot stops
being displayed
. They are told by email and can come back by paying a top-up, which
adds to the amount already paid and never replaces it.

3. Prices, tax and invoicing

The amounts quoted and chosen by the advertiser are stated before tax. Any
sales tax that applies is added at checkout, calculated from the billing address by our payment
provider. The ranking of spots is established on the pre-tax amounts, so that an
advertiser’s tax situation has no effect on its position. Every payment produces a compliant
invoice, issued by the publisher through Stripe.

4. No subscription

The service involves no subscription, no recurring charge and no automatic
renewal. The advertiser therefore has nothing to cancel. It may ask at any time for its spot to be
withdrawn, from its advertiser account or by writing to [email protected]; such a withdrawal,
at the advertiser’s own initiative, does not entitle it to a refund.

5. Payment and invoices

Payments are processed by Stripe. The publisher never has access to any card data. Every payment
produces an invoice, viewable and downloadable at any time from the
advertiser account of the Best in network,
shared across every city.

6. Refunds

Amounts paid are not refunded, the service being performed as soon as the spot is published. In
particular, dropping out of the 10 displayed spots because of higher bids does not
entitle the advertiser to any refund
: it is the normal working of the auction mechanism,
accepted at the time of booking. The following are refunded: duplicate payments, technical failures
attributable to the site, and the impossibility of publishing the spot. Any request should be sent
to [email protected] and is reviewed within 14 days.

7. Content of the listing

The advertiser warrants that the information it provides (name, contact details, website) is
accurate and that it is entitled to publish it. Unlawful, misleading or off-topic content is
refused. The publisher may withdraw without notice a spot that breaches these rules, or whose
destination website becomes unreachable or unsafe, with no compensation and no refund; the
advertiser is told by email and may ask for the spot to be restored once the content or the website
has been fixed.

8. Editorial independence

The rankings published on the site are built using the method described on our
methodology page. No payment allows a business to enter them, move
up in them or leave them, nor to obtain the “Our pick” box. Booking an advertising spot grants no
right over editorial content. Conversely, appearing in a ranking or not has no effect on the price
of a spot.

9. Availability of the service

The publisher makes every effort to keep the site accessible without being able to guarantee it
continuously. If there is an interruption, spots are restored exactly as they were, in the same
order, as soon as the site is back online; no compensation is due.

10. Personal data

The data provided is used solely to manage the spot and to issue invoices. It is not passed on
to third parties. See our privacy policy.

11. Governing law

These terms are governed by French law, the publisher being established in France. In the event
of a dispute, an amicable solution will be sought before any legal action.
